Emergency Watershed Protection Program FloodPlain Easements (EWPP-FPE)

Applications

Landowners may only enroll land in EWPP-FPE through a permanent easement. Applications for enrollment of land in a EWPP floodplain easement will be accepted during March 9 - April 10, 2009. Interested landowners may make application by visiting their local NRCS field office and provide a copy of their deed to the land. Landowners may be individuals, entities or units of State or local government.

  1. Have been damaged by flooding at least twice within the previous 10 years or at least once in the last twelve months; or
  2. Be inundated or adversely impacted as a result of a dam breach; and
  3. Be other lands within the floodplain that are functionally dependent on acres eligible under b. above, or that would improve the practical management of the easement. No more than one acre of other land may be enrolled for each acre of land eligible under b above;

Restoration will not be implemented when the primary purpose is wetland restoration or maximizing wildlife habitat benefits. Only the level of restoration necessary to control erosion and provide proper functioning of the floodplain for flood attenuation is allowed. It is expected that restoration will be primarily vegetative practices with a minimal amount of structural practices installed. Cost-share for restoration will be 100 percent of the actual cost of installing restoration practices.

Compensation

When the landowner indicates a desire to continue the enrollment process, an Option Agreement to Purchase (Form AD-1157) will be prepared to offer the landowner the lowest of –

  1. The fair market value of the land, as determined by the Secretary, using an area-wide market analysis or survey.
  2. The amount corresponding to a geographical cap, as determined by the Secretary in regulations; or
  3. The offer made by the landowner.

All easements will be recorded on the NRCS-LTP-20, Emergency Watersheds Protection Program Floodplain Warranty Easement Deed (PDF; 295 KB) , dated August 2008.
