Texas Bulletin No. TX180-08-02

SUBJECT: CPA – Comprehensive Nutrient Management Plan Development for Concentrated Animal Feeding Operation

Purpose: Provide guidance on documenting CNMP elements on a CAFO with a Pollution Prevention Plan (PPP) in Texas.

Guidance Policy and Background:
CAFOs in Texas are required to develop and maintain a PPP on-site in accordance with requirements set by the Texas Commission on Environmental Quality (TCEQ). The PPP has been required since 1998 and contains the majority of the information required by NRCS for a CNMP. There are two required elements of the CNMP which are not typically addressed in the PPP-- these are Feed Management and Land Treatment. In order to reduce duplication, paperwork, and confusion; Texas NRCS recommends that the components of a CNMP that are already in the PPP are cross-referenced in the Table of Contents. Exhibit 1 contains an example of such a table of contents.

The CNMP specialist is responsible for ensuring that the components in the PPP and CNMP are consistent. Additionally, the CNMP specialist should check the PPP to make sure that the cross-referenced information is included in the PPP.

The planning for the CNMP should be based on the current operation with consideration given to the planned operation for the next year. The CNMP is a dynamic working document and will need annual updates to the nutrient management plan. The waste utilization and nutrient management plan prepared in accordance with Conservation Practice Standards – Codes 590 and 633 should be updated annually and will not necessarily match the Nutrient Management Plan submitted with the permit application. There are many reasons why this may occur including, but not limited to:

  • the facility is not operating at the maximum permitted capacity (so less manure is generated);
  • the manure produced is being shipped off-site; the operator is rotating the land application of manure between fields on a set schedule; or
  • the operator is changing the cropping system.

All land application fields under the control of the operator should be authorized by TCEQ prior to applying manure or wastewater.
